The Schechter brothers operated wholesale poultry slaughterhouse markets in Brooklyn, New York. They purchased live poultry primarily from commission men at markets in New York City, where approximately 96% of the poultry arrived from other states. After purchasing the poultry, the Schechters transported it to their Brooklyn slaughterhouses, where it was slaughtered according to kosher requirements and sold to local retailers and butchers, typically within 24 hours. The Schechters were convicted of violating multiple provisions of the “Live Poultry Code,” which had been established under Section 3 of the National Industrial Recovery Act. The violations included permitting customers to select individual chickens from coops (rather than requiring “straight killing”), selling unfit chickens, failing to comply with local inspection regulations, and violating wage and hour provisions.
