Congress has recently enacted a law requiring all males 18-30 to take a physical examination each year, with the results available to the public upon request. The intent of the legislature was to make public the health status of males eligible for selective service. Reckless, a 25-year-old law student, has herpes. He has recently sent resumes to many prestigious firms and is now fearful that info about his herpes as a result of college indiscretions will become public knowledge.
If you are a legal advisor to Congress, what would you say about the constitutional basis for the new federal law?
