Just before the restaurant opens, Raphael drops out of the partnership. Michael and Leonardo sell pizza and drugs for a year before they are arrested and charged as co-defendants. At trial, the prosecution offers witness testimony to prove that Michael created the plan to sell drugs. Raphael testifies that Michael texted him, “I am making a plan to sell pizza and drugs.” Raphael also testifies that Michael said, “I’ve succeeded in carrying out my plan to sell pizza and drugs.” Finally, a customer testifies that Leonardo said during a drug delivery, “Michael created the plan to deliver drugs.”
