April attends an art show with instructions from June to purchase a sculpture no taller than 3 feet. At the show, April signs a contract on June’s behalf to buy a 6-foot-tall sculpture from an artist for $1,000. April does not inform the artist that she is acting as a buying agent for a principal. Although June is initially displeased, June accepts the sculpture when it is delivered and pays $500 to the artist. Now, the artist is seeking payment of the remaining $500.
Can June be held liable for the remaining $500 under the Third Restatement of Contracts?
