Joey has been charged with attempted bribery. The prosecution alleges that Joey called Judge Renee at her home and offered to pay Judge Renee $10,000 if she would dismiss with prejudice a civil action pending against Joey’s brother. Judge Renee had made a tape recording of the call with her answering machine. The tape recording was admitted into evidence at Joey’s trial. The prosecutor has also requested that Joey read a statement containing the same words on the tape recording for the purpose of allowing the jury members to compare Joey’s voice to the voice on the tape recording. Joey’s attorney objects to the request on the grounds that it violates Joey’s privileges against self-incrimination.
