During a two-month span, there were twenty robberies in the Boston area. The robberies were carried out by a single individual that entered the banks wearing a ski mask and carrying an Uzi submachine gun. The police received information from a reliable informant that Larry “Legs” Larceny was the person responsible for the robberies. Acting on this tip, the police secured a valid arrest warrant and went to Larceny’s home to apprehend the suspect. When the officers rang the doorbell, Larceny opened the door and was placed under arrest.
Larceny, who was only wearing boxer shorts with dollar signs printed on them, asked the officers if he could put on a shirt and pants. Officer Ovaltine asked Larceny if anyone else was present in the house. Larceny indicated that he was alone. Officer Ovaltine then accompanied Larceny to his bedroom to change his clothes. When Larceny asked permission to enter the closet for his pants, Officer Ovaltine told him that he needed to inspect the closet first. While Ovaltine was inside the closet, he saw a ski mask that he recognized as part of the apparel worn by the bank robber. Ovaltine confiscated the ski mask and then allowed Larceny inside the closet to change his clothes.
While Ovaltine and Larceny were in the bedroom, Officer Oreo decided to conduct a protective sweep of the other rooms of the dwelling to see if any accomplices were present. Upon entering a back storage room, Oreo saw a box containing a
large amount of $100 bills. Oreo confiscated the money, which was later determined to be part of the loot stolen during one of the bank robberies.
Larceny is subsequently prosecuted for bank robbery. The prosecution seeks to introduce the ski mask and the money found in his home into evidence. Larceny’s attorney moves to exclude both items.
