Hugh was a candidate for mayor in the town of Peakton. After receiving a tip from an anonymous phone caller, the city attorney began investigating contributions to Hugh’s campaign. The investigation continued and eventually led to the successful prosecution of Hugh for failing to comply with state laws requiring public disclosure of all campaign contributions. During the course of the investigation, the city attorney had demanded and received records of Hugh’s bank accounts from Hugh’s bank.
Hugh is now appealing the conviction claiming that the admission of the bank records was in violation of his constitutional rights.
