After the infamous 1986 Miami shootout, the FBI sought a new, more powerful pistol round for its agents, resulting in the 10mm. The FBI requirements for this round had a muzzle energy of 650 ft/lbs and velocity of 1400 feet/second shooting a bullet weighing 135 grains. Smaller statured agents could not deal with the recoil of this pistol, and government sales dried up. The platform was about to go extinct when Triple Tap Ammunition Co. formed and began advertising “Full-Power FBI 10mm” for sale. On the basis of this claim, 10mm pistol owners everywhere got excited about being able to purchase full power factory ammo for their guns. James Crockett purchased 10 boxes of ammunition from TTAC at $50/box. Shooting them through a chronograph, however, he discovered that the bullets weighed 165 grains and had a muzzle velocity of 1250 feet/second, although the round still attained 650 ft/lbs of energy. Evaluate Crockett’s breach of express warranty claims against TTAC.
