Edward’s will is contested by his family in court. Alice testifies that she heard Byron saying into his cell phone, “Edward just told me that he’s shipping off to fight in World War II. The old man has lost his mind.” Alice’s testimony is offered to prove that Edward was not of sound mind. A statement of Byron’s cell phone records printed out by Horizon Company is offered to prove that Byron was speaking to a law firm at the time. Alice also testifies that she heard Edward’s parrot saying, “Byron killed Edward!” This testimony is offered to prove that Byron killed Edward. Are the statements of Byron, Horizon Company, and the parrot inadmissible hearsay?
