Lee was a 17-year-old high school dropout who lived in Oakland and belonged to a neighborhood gang called the Raiders. One day Brady was walking along a street in Oakland. Lee saw Brady and knew he was a member of the Pats, a rival gang based in Berkeley. Lee accosted Brady and pushed him to the ground. Lee then pulled out a knife, held it to Brady’s throat, and said: “Who gave you permission to enter our turf?” Before Brady could respond, Peyton, who was Lee’s friend and a fellow Raider gang member, approached and asked what was happening.
Lee told Peyton that Brady belonged to the Pats and came to Oakland looking for trouble. Peyton then said to Davis, “Why don’t you show him what happens to Pats who come to Oakland looking for trouble?” Lee then stabbed Brady in the throat, killing him.
