The defendant, Deutsch, ran a series of advertisements that it had prepared for the other defendant, Samsung. Each advertisement contained an element of pop culture and a Samsung electronic product. The ad in question featured a robot in a wig, gown, and jewelry selected by the defendants to resemble those worn by Vanna White (the plaintiff). The robot stood next to a game board, very similar to the one featured in Wheel of Fortune, gesturing as the plaintiff does on the TV show. The defendants referred to this ad as the “Vanna White” ad. The plaintiff, unlike other celebrities show in the ads, was not compensated.
