In 1966, Robert Bushnell (Plaintiff-Appellee) sold a motel to the Kings (Defendant-Appellants). The Plaintiff-Appellee then built another motel, the Desert Inn, on an adjoining property. The Defendant-Appellants filed suit against Plaintiff-Appellee, alleging misrepresentation in the 1966 sale of the motel. In 1968, the Defendant-Appellants erected a structure 85 feet in length and 18 feet in height 16 inches from the Plaintiff-Appellee’s property line. The Defendant-Appellants claim this structure was built as an advertisement for their motel and to differentiate between the two motels, not as a spite fence. The trial court was presented with substantial evidence that the structure obstructed light and air from reaching the Desert Inn, had little to no advertising value due to its location and type, and that the structure was the largest structure then in existence in the area.
