The plaintiffs lived next door to the defendant. They had a very contentious relationship with him. There were issues such as the defendant leaving debris in the plaintiff’s yard, and, on a regular basis, the defendant flipped off the plaintiffs when they drove by him in the neighborhood. One day, the Plotnik’s dog Romeo, a twelve pound miniature pincher, got into the defendant’s yard, and the defendant hit Romeo with a bat. This resulted in serious injury to Romeo’s leg, requiring surgery at a cost of $2600, and Romeo needed the aid of a stroller to get around. The Plotnik’s sued.
