Craig Wrecking Company v. S.G. Loewendick & Sons, Inc.

On March 23, 1973, the plaintiff, Craig Wrecking Company, entered into a lease with the Pringle heirs for certain property to be used as a landfill. The lease had a five year term, expired March 31, 1978, and included an option to renew the lease for an additional five years. During the lease period Craig Wrecking Company frequently failed to make timely lease rent payments. Craig Wrecking Company never satisfied the full amount of payment required under the original lease term. At the expiration of the original lease term, Craig Wrecking Company had not exercised any written option to renew the lease. March 7, 1983, plaintiffs were advised that the Pringle heirs had engaged the defendant, S.G., to take charge of the landfill operation. March 11, 1983, S.G. entered the property and dumped certain items from the property into the lake abutting it, altering the contour of the dump. Craig Wrecking Company remained in possession of the property despite S.G.’s entry and purchased the property from the Pringle heirs in October 1983. Two years later, Craig Wrecking Company sued S.G. for trespass.
