Rubright, an employee of Chemcast (Plaintiff), filed an application for a dual durometer grommet made of a PVC composite using a formula that was a trade secret of the specific supplier he got it from. Although the grommet had only been made successfully using this particular material, in the specification Rubright did not include the name of the supplier and material brand but instead provided a list of generic potential materials. Rubright's supplier, Reynosol, had spent months and hundreds of hours developing the composite for the Plaintiff's new grommet. Plaintiff subsequently brought suit against Arco (Defendant) for infringing on the grommet patent. The district court held that Plaintiff had violated the 35 U.S.C. § 112 best mode requirement for failing to disclose either the method of manufacture or the specific supplier of the preferred composite. Plaintiff appealed.
