Humphers v. First Interstate Bank of Oregon
Facts
Mackey was the attending doctor when Humphers (Plaintiff), then known as Elwess, gave birth to a baby girl. The next day the baby was given up for adoption. Twenty-one years later, the daughter sought out Mackey. With his help, the daughter was able to gain access to the sealed adoption papers. She was then able to locate Plaintiff, and Plaintiff was upset about this. Mackey had died since then, so Plaintiff filed a lawsuit against his estate (Defendant), administered by First Interstate Bank (Defendant), seeking damages under various theories. On all counts the trial court sustained Defendant's demurrer. The court of appeals reversed on two counts based, respectively, on invasion of privacy and breach of contractual obligation of secrecy. The Oregon Supreme Court granted review.
