U.S. v. Hubbell
Facts
Respondent was served with a subpoena that requested documents related to the investigation of the Whitewater Development Corporation. Respondent invoked his Fifth Amendment privilege against self-incrimination and refused to acknowledge that he had the documents requested. After the special prosecutor served Respondent with an order requiring production of the documents pursuant to a grant of immunity for Respondent, Respondent produced 13,120 pages of the documents. The documents were then used to indict Respondent on tax and fraud charges, and the District Court dismissed the indictment, holding that the use of the documents violated federal law. The Court of Appeals directed the District Court to, “determine the extent and detail of the Government’s knowledge of respondent’s financial affairs on the day the subpoena issued,” and the Supreme Court granted certiorari to determine the two issues below.
