Hebron v. State
Facts
Dr. Hilary Weiner arrived home to find her doorframe splintered and so broken that it was impossible to close and latch the door. Splinters and chips from the door were found on a mat inside the house. One of Weiner’s neighbors testified to seeing Mr. Hebron (Defendant) walk in the direction of Weiner’s home on the day of the break-in, and to then hearing a loud bang. The neighbor further testified to seeing Defendant emerge from the direction of Weiner’s house after the bang. Defendant was convicted of breaking and entering a dwelling house, attempted breaking and entering a dwelling house, and malicious destruction of property. Defendant appealed, arguing that the prosecution failed to present sufficient evidence to support his breaking and entering conviction.
