United States v. George F. Fish, Inc.
Facts
George F. Fish, Inc. (Defendant), a wholesale dealer of fruits and vegetables, along with company salesman Michael Simon (Defendant), were charged with “unlawfully, willfully, and knowingly,” charging excessive amounts for the goods in violation of § 2 of the Emergency Price Control Act of 1942. A jury found the company guilty and imposed fines. The jury also found Simon guilty and sentenced him to a term of imprisonment. Defendant appealed and argued that it could not be criminally liable for the illegal acts committed by one of its employees.
