People v. Rojas
Facts
Hall was arrested by the police after stealing about $4,500 worth of electrical conduit and taken to the police station. While there, Hall told the police that he had an agreement with Rojas to sell him all the electrical materials Hall had stolen. While at the police station, Hall called Rojas, Hidalgo, (Defendants) and another individual to set up a meeting to hand over the stolen material in a truck at a place designated by Rojas. Thereafter, Rojas and Hidalgo drove the truck away containing the stolen conduit and were subsequently arrested by the police and charged with receiving stolen property. After waiving their right to a trial by jury, Rojas and Hidalgo were found guilty. Each defendant’s motion for a new trial was denied and the court sentenced Rojas to probation and sentenced Hidalgo to a term in prison. Defendants appealed.
