Facts
Leo Facto (plaintiff) entered an agreement with Snuffy Pantagis Ent., Inc., t/a Pantagis Renaissance (Pantagis) (defendant) to hold a wedding reception at Pantagis' banquet hall. Facto made a propel installment of $10,578.00. The composed contract between the gatherings incorporated a force majeure clause, which pardoned Pantagis' execution if it was kept from performing because of a demonstration of God or unexpected conditions, including a power failure. Around forty-five minutes after Facto's reception started, a power failure made the lights and the ventilation system closed off. The absence of power kept the band, photographer, and videographer from playing out their obligations. The reception was held on a hot and humid day, leaving visitors greatly awkward without an aeration and cooling system. Following a few hours, Pantagis asked for that the police evacuate the banquet hall. Facto along these lines brought a breach of agreement activity to recuperate the prepayment of $10,578.00. The trial court found that the force majeure clause precluded Facto’s claim and dismissed the complaint.
