In response to Adkins’ suit, which was proposed as a class action under the Fair Labor Standards Act (FLSA), Labor Ready filed a Motion to Compel Arbitration, based on an agreement which was signed by all employees, upon employment. Adkins countered, arguing that the employees did not receive consideration for their agreement to arbitrate, that said agreement was unconscionable, and unenforceable as it was a condition to employment. The District Court granted the motion and Adkins appealed alleging the agreement was unenforceable.
