Facts
The Defendant, Minnesota (Defendant), enacted a statute banning the retail sale of milk in plastic nonreturnable, nonrefillable containers. However, the state allowed the sale of milk in paperboard cartons. The express purpose was to address the problem of solid waste management in the state. The Plaintiff, Clover Leaf Creamery Co. (Plaintiff) filed suit to enjoin the statute, arguing that the actual basis for it was to promote the economic interest of certain segments of the local dairy and pulpwood industry and to harm the plastics industry.
