The Respondent sought a new Recreation Director. The Petitioner was the only woman to apply for the job. A five-member committee interviewed the eight applicants and chose a male. The Plaintiff sued under Title VII of the Civil Rights Act of 1964 (the Act) alleging discriminatory intent. After a 2-day trial, during which the court heard testimony from the Petitioner, Mr. Kincaid, the successful applicant and the five members of the selection committee, the court issued a brief memorandum of decision setting forth its finding that Petitioner had been denied the position on account of her sex. The Court of Appeals for The Fourth Circuit reversed, holding that the district court’s crucial findings were clearly erroneous. The Supreme Court of the United States (Supreme Court) granted certiorari.
