The Respondents were black employees of the Petitioner Pullman – Standard and brought suit against them and the Petitioner Union, asserting that the seniority system violated the Act. The District Court found that the differences in terms, conditions, or privileges of employment resulting from the seniority system were not the result of an intent to discriminate because of race or color. It held that the system satisfied Section: 703(h) of the Act. The Court of Appeals reversed citing differences in the terms, conditions, and standards of employment for black and white workers at the Petitioner Pullman-Standard resulted from an intent to discriminate.
